Who is entitled to overtime pay
Part 4 of the Employment Act covers workmen earning up to $4,500 a month in basic salary and other employees, apart from managers and executives, earning up to $2,600. A workman is someone whose job is mainly manual work, such as a cleaner, driver or machine operator.
How overtime pay is worked out
- Hourly basic rate = 12 × monthly basic salary ÷ (52 × 44).
- For non-workmen the hourly rate is capped at $13.60, the rate at a $2,600 salary.
- Overtime rate = 1.5 × the hourly basic rate.
- Overtime pay = overtime rate × hours worked beyond your normal hours.
| Basic salary | Hourly basic rate | Overtime rate | 20 hours of overtime |
|---|---|---|---|
| $1,800 | $9.44 | $14.16 | $283.22 |
| $2,000 | $10.49 | $15.73 | $314.69 |

| $4,500 | $23.60 | $35.40 | $708.04 |
The table is for workmen. A non-workman on $2,600 gets $20.40 an hour for overtime.
Limits and timing
You can work at most 72 hours of overtime a month, and no more than 12 hours a day in total. Overtime must be paid within 14 days after the end of the salary period. Basic salary excludes allowances, bonuses and overtime itself, so these do not raise your hourly rate.
Questions and answers
How much is overtime pay on $2,000 a month?
$15.73 an hour, from an hourly basic rate of $10.49. Ten hours of overtime pays $157.34.
Do executives get overtime pay?
Managers and executives are not covered by Part 4 of the Employment Act, so overtime depends on their contract. The same is true for non-workmen earning more than $2,600.
Why does MOM use 52 × 44 in the formula?
It converts a monthly salary into an hourly rate: 12 months of pay divided by 52 weeks of 44 hours, the longest normal working week the Act allows.
What is the overtime rate for a non-workman on $2,600?
$20.40 an hour. MOM's own example is 2 hours for $40.80.
